1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your access to and use of the Card Identifier mobile application (also known as RookieScan / Card Identifier) and the website located at cardidentifier.app (collectively, the “Service”), provided by Card Identifier (“we,” “us,” or “our”).

By downloading, installing, accessing, or using the Service, you signify your agreement to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you must not access or use the Service.

2. Description of Service & Eligibility

Card Identifier is a digital tool designed for sports card and trading card collectors. Features include camera-based card scanning, card set and parallel identification, pre-grading condition checklists, estimated secondary market values, and digital collection management binders.

Eligibility: You must be at least 13 years of age (or 16 where required by local law) to use the Service. If you are under 18, you represent that you have reviewed these Terms with your parent or legal guardian and obtained their consent.

3. Informational Nature of Card Values & Grading Prep

Card Identifier does not guarantee that any card will sell, trade, or realize the estimated values shown. The collectible trading card market is highly volatile, speculative, and subjective. Card values fluctuate significantly based on microscopic physical condition, sub-grades, market liquidity, player performance, and individual buyer demand.

Our pre-grading inspection tool is an educational checklist to help collectors inspect card centering, corners, edges, and surfaces before submitting cards to third-party grading authenticators. Card Identifier is NOT an official grading company and does not assign binding, certified, or guaranteed numerical grades.

4. User Accounts & Security

You may browse public guides and use basic scanning tools without an account. However, accessing collection backup, cross-device sync, and extended portfolio features requires creating an account.

• You agree to provide accurate, current, and complete registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to notify us immediately at support@cardidentifier.app of any unauthorized access or security breach.
• Card Identifier will not be liable for any loss or damage arising from your failure to protect your login credentials.

5. User Content & Card Scans

When you capture or upload photos of trading cards using the Service (“User Content”):

• Ownership: You retain all ownership rights in your User Content.
• License: You grant Card Identifier a worldwide, non-exclusive, royalty-free license to use, host, reproduce, analyze, and process the images solely for the purpose of operating, maintaining, improving, and optimizing our card recognition algorithms.
• Representations: You represent and warrant that you have all necessary rights to upload any image and that your User Content does not infringe upon any third party’s intellectual property or privacy rights.

6. Acceptable Use & Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Attempting to reverse engineer, decompile, or extract the source code or proprietary computer vision models of Card Identifier.
• Using automated scrapers, spiders, robots, or scripts to bulk-query our card database or pricing indexes without written authorization.
• Overburdening, disrupting, or launching denial-of-service attacks against our infrastructure.
• Uploading malicious code, viruses, or inappropriate, defamatory, or unlawful imagery through the card camera or contact forms.
• Reselling, sublicensing, or commercially exploiting our valuation API or data feeds without an explicit enterprise agreement.

7. Subscriptions, In-App Purchases & Billing

Card Identifier offers free features as well as optional premium scan tiers or auto-renewing subscriptions (“Card Identifier Pro”).

• Billing: Subscriptions and in-app purchases are billed through your Apple ID or Google Play account at confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours prior to the end of the current billing cycle.
• Cancellations & Refunds: You can manage or cancel your subscription at any time in your Apple App Store or Google Play account settings. All refund requests are governed by Apple and Google platform refund policies.

8. Trademarks, Intellectual Property & Non-Affiliation

The Card Identifier software, interface, design, algorithms, text, graphics, and logos are the proprietary intellectual property of Card Identifier and protected by applicable copyright and trademark laws.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT CARD IDENTIFICATION WILL BE 100% ERROR-FREE, THAT ESTIMATED VALUES WILL MATCH ACTUAL SELLING PRICES, OR THAT THE SERVICE WILL OPERATE UNINTERRUPTED OR SECURE FROM THIRD-PARTY INTERFERENCE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CARD IDENTIFIER, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES—INCLUDING LOSS OF PROFITS, LOSS OF CARD VALUE, TRADING LOSSES, GRADING DISAPPOINTMENTS, OR DATA LOSS—ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICE.

11. Indemnification

You agree to defend, indemnify, and hold harmless Card Identifier and its officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these Terms, your User Content, or your misuse of the Service.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Card Identifier operates, without giving effect to conflict of law principles.

In the event of any dispute or controversy arising out of these Terms, the parties agree to first attempt informal resolution by contacting support@cardidentifier.app with a detailed description of the dispute.

13. Modifications to Terms

We reserve the right to revise or update these Terms at any time. When we make changes, we will post the updated Terms on this page with a revised “Effective & Last Updated” date. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of the changes.
